By accessing or using the Website, and by purchasing any artwork or goods (“Products”) from the Website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Website or purchase any Products.
1. General Conditions
1.1. Acceptance of Terms: These Terms form a legally binding contract between you and Urban Uplift Design.
1.2. Changes to Terms: We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Website following the posting of any changes constitutes acceptance of those changes.
1.3. Eligibility: By agreeing to these Terms, you represent that you are at least the age of majority in your province or state of residence, or that you are the age of majority in your place of residence and you have given us your consent to allow any of your minor dependents to use this site.
2. Products, Orders, and Pricing
2.1. Product Descriptions: We strive to display the colours and images of our Products as accurately as possible. However, we cannot guarantee that your device’s display of any colour will be accurate. All descriptions of Products or Product pricing are subject to change at any time without notice, at our sole discretion.
2.2. Order Acceptance: All orders placed through the Website are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or problems identified by our credit and fraud avoidance department.
2.3. Pricing and Payment: All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes, shipping, and handling charges, which will be added at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website.
3. Shipping and Delivery
3.1. Shipping Policy: Shipping options, costs, and estimated delivery times are detailed as an estimate at the time of purchase.
3.2. Risk of Loss: The risk of loss for all purchased Products passes to you upon our delivery to the carrier. We are not responsible for packages lost or damaged in transit. We recommend purchasing shipping insurance (if available).
3.3. International Shipping (If Applicable): For international orders, you are responsible for any customs duties, taxes, or import fees levied upon delivery.
4. Returns and Refunds
4.1. Return Policy: Our policy is valid for 14 days from the date of delivery. To be eligible for a return, your item must be unused, in the same condition that you received it.
4.2. Non-Returnable Items: Gift cards, commissioned pieces, digital downloads, or items marked as final sale.
4.3. Refunds: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment, within a certain number of days.
5. Intellectual Property Rights
5.1. Ownership of Artwork: When you purchase a physical piece of artwork (e.g., an original painting or limited-edition print), you own the physical object. However, the artist retains all copyright and reproduction rights to the artwork, regardless of the physical object’s ownership.
5.2. Non-Commercial Use: Unless specifically stated otherwise in writing (e.g., through a separate commercial license agreement), the artwork is sold for your private, non-commercial use only. You may not reproduce, duplicate, copy, sell, or exploit any artwork or content from the Website for any commercial purpose without express written permission from the artist.
5.3. Website Content: All content on the Website, including text, graphics, logos, images, and the compilation thereof, is the property of [Your Legal Business Name] and is protected by copyright and other intellectual property laws.
6. Limitation of Liability

These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to principles of conflicts of law.
